Terms of Service

By accessing or using the Service you represent and warrant that: (a) you are at least 13 years of age; (b) you have the legal capacity to enter into a binding contract; (c) you have read and agree to these Terms and our Privacy Policy; and (d) if you are using the Service on behalf of an organisation, you have authority to bind that organisation to these Terms.

Users between the ages of 13 and 17 may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on their behalf.

The Infinite Story Engine LLC operates a voice-based interactive AI storytelling platform. The Service uses real-time voice processing, large language models, and AI-generated speech to create personalised narrative experiences. Key technical components include:

• Real-time voice capture from your microphone, transmitted over WebRTC to our servers.
• Speech-to-text transcription processed by third-party providers (e.g., Deepgram, AssemblyAI).
• Story generation by AI language models (e.g., Anthropic Claude) based on your spoken inputs.
• AI-synthesised narration delivered back to you in real time (e.g., OpenAI TTS, Inworld voice).
• Session management, story history, and account features hosted in our cloud infrastructure.

Features, pricing, AI providers, and availability may change over time. We will attempt to provide advance notice of material changes.

To access most features you must create an account. You agree to:

• Provide accurate, current, and complete information during registration and keep it updated.
• Maintain the confidentiality of your password and not share your account with others.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately at legal@infinitestoryengine.com if you suspect unauthorised access.
• Use only one account per person unless we have explicitly granted you permission for more.

We reserve the right to refuse registration, suspend, or terminate accounts at our discretion, including for violations of these Terms.

You may request deletion of your account by contacting us at legal@infinitestoryengine.com. We will delete your personal data within 30 days, subject to any legal retention obligations.

Some features require a paid subscription. By subscribing you agree to the following:

• Fees: you agree to pay all fees as described on our pricing page at the time of purchase.
• Billing cycle: subscriptions are billed on a recurring monthly basis. Your subscription renews automatically on the same day each month unless you cancel before the renewal date.
• Auto-renewal notice: by subscribing you authorise us (through Stripe) to charge your payment method on file at the start of each billing period.
• Cancellation: you may cancel at any time through your account dashboard or the Stripe billing portal. Cancellation takes effect at the end of the current billing period; you retain access until then.
• Refunds: we do not provide refunds for partial billing periods, except where required by applicable law (e.g., EU consumer cooling-off rights). If you believe a charge is in error, contact us within 30 days.
• Price changes: we may change subscription prices. We will give you at least 30 days' notice by email before a price increase takes effect. Continued use after the effective date constitutes acceptance.
• Failed payments: if a payment fails, we may downgrade your account to the free tier or suspend access until payment is resolved.
• Taxes: prices are exclusive of applicable taxes (VAT, GST, sales tax) unless stated otherwise. You are responsible for any applicable taxes.

All payments are processed by Stripe, Inc. By subscribing you also agree to Stripe's Terms of Service.

We may offer free story experiences, trial periods, or a free tier with limited features. Free access is provided at our discretion and may be modified or discontinued at any time without notice. Features available on the free tier are subject to usage limits as described on our pricing page.

You are solely responsible for your conduct while using the Service. You agree not to:

• Use the Service to generate, store, or transmit content that is unlawful, defamatory, obscene, threatening, harassing, hateful, or that promotes violence or discrimination.
• Attempt to elicit sexual content involving minors or any content that sexualises individuals without consent.
• Attempt to reverse-engineer, decompile, disassemble, or extract source code or model weights from the Service.
• Circumvent, disable, or interfere with any security feature, usage limit, rate limit, or access control.
• Use automated scripts, bots, or scraping tools to interact with the Service at scale.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Introduce malware, ransomware, spyware, viruses, or any other harmful or destructive code.
• Use the Service in a manner that disrupts, degrades, or impairs its performance or infrastructure.
• Resell, sublicense, white-label, or commercially exploit access to the Service without our prior written consent.
• Use the Service to harvest personal data about other users.
• Violate any applicable local, national, or international law or regulation.

We reserve the right to investigate violations and take appropriate action, including removing content, suspending access, and cooperating with law enforcement.

The Service relies on your voice as the primary input. By using the Service you acknowledge and agree that:

• Your voice is captured by your device's microphone and transmitted in real time to our servers and third-party AI providers for processing. See our Privacy Policy for details.
• AI-generated story content is fictional, created algorithmically, and provided for entertainment purposes only. It does not constitute advice — medical, legal, financial, or otherwise.
• AI models may occasionally produce unexpected, inaccurate, or unintended outputs. We are not liable for the content of AI-generated narratives.
• We do not guarantee that the AI will understand or accurately transcribe your voice in all conditions (e.g., background noise, accents, microphone quality).
• You must not use voice prompts to attempt to override AI safety guidelines or to generate content that violates our Acceptable Use policy.

Your content: You retain ownership of the spoken input you provide during sessions (your choices, prompts, and voice). By using the Service, you grant us a limited, worldwide, royalty-free licence to process your voice input solely for the purpose of delivering the Service to you.

AI-generated output: Story narratives generated by the AI are provided to you under a limited, non-exclusive, non-transferable, revocable licence for personal, non-commercial use only. We and our licensors retain all other rights in the AI-generated content. You may not reproduce, distribute, or commercially exploit AI-generated content without our prior written consent.

Our property: The Service — including its design, code, trademarks, logos, pre-recorded stories, and underlying AI models — is the intellectual property of The Infinite Story Engine LLC and its licensors. Nothing in these Terms transfers ownership of any intellectual property to you.

Feedback: If you submit suggestions, ideas, or feedback about the Service, you grant us a perpetual, worldwide, royalty-free licence to use that feedback for any purpose without compensation to you.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

We respect intellectual property rights. If you believe that content accessible through the Service infringes your copyright, please send a DMCA notice to legal@infinitestoryengine.com with the following information: (a) a description of the copyrighted work you claim has been infringed; (b) identification of the allegedly infringing material; (c) your contact information; (d) a statement of good faith belief; (e) a statement of accuracy and authority, made under penalty of perjury; and (f) your electronic or physical signature.

The Service integrates with third-party providers (including Stripe, LiveKit, Anthropic, Deepgram, Inworld, and OpenAI) whose products are governed by their own terms and privacy policies. We are not responsible for the practices of these providers. The Service may also contain links to third-party websites; we do not endorse and are not responsible for those sites.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR FREE FROM OFFENSIVE MATERIAL.

AI-generated story content is purely fictional and provided for entertainment only. We are not responsible for any decision made in reliance on AI-generated content.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE INFINITE STORY ENGINE LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION — ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID US IN THE THREE CALENDAR MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow limitation of certain warranties or liabilities. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless The Infinite Story Engine LLC and its members, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party right, including intellectual property or privacy rights.

Informal resolution: Before initiating any formal proceeding, you agree to contact us at legal@infinitestoryengine.com and give us 30 days to attempt to resolve the dispute informally.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS PROCEEDING.

By you: You may stop using the Service and delete your account at any time. Cancelling a paid subscription does not immediately delete your account or data.

By us: We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, for non-payment, or for any other legitimate business reason.

Upon termination: your licence to use the Service ends immediately; we may delete your account data subject to our Privacy Policy; and any accrued rights and obligations survive, including Sections 7, 8, 12, 13, 14, 15, 16, and 18.

Waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction, including in connection with a merger, acquisition, or sale of assets.

Force majeure: We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including acts of God, war, terrorism, government actions, infrastructure failures, or internet outages.

No agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and The Infinite Story Engine LLC.

We may update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
